TERMS AND CONDITIONS
ONEPLUS KEYBOARD FUNDING CAMPAIGN
Before you contribute RedCoins to the OnePlus Keyboard Funding Campaign (the “Campaign”), please review the following terms and conditions:
1.Voluntary Contributions. All RedCoins contributions to the Campaign are made voluntarily and at your sole discretion and risk.
2.Between December 15, 2022, 4:00 AM EST and Feburary 7, 2023, 9:00 AM EST and January 20, 2023, 4:00 AM EST, you may make a one-time contribution of up to 100 RedCoins to the Campaign, and receive triple the amount of contributed RedCoins back into your account during the product pre-order period. RedCoins discounts will be available for this product during pre-order period. Triple RedCoins will be credited to the users’ accounts during the product pre-orders stage and eligible users will be notified by e-mail.
3.Eligibility. If you are over eighteen years old by the start of the Campaign and reside in the United States or Canada, you are eligible to contribute to the Campaign. Each eligible user can only invest once. Subsequent investments of RedCoins cannot be added. RedCoins will be valid for one year
4.No Refunds. All RedCoins contributions to the Campaign are non-refundable unless the Campaign is canceled or terminated by the Promotion Parties.
5.Contributions Are Not Purchases. RedCoins contributions to the Campaign only entitle you to receive triple the amount of contributed RedCoins back into your account during the product pre-order period. Your contribution is not a pre-order of the OnePlus Keyboard and does not entitle you to receive the OnePlus Keyboard free of charge.
6.Limitation of Liability. By contributing to the Campaign, you waive all rights to and hold OnePlus USA Corp. (the “Sponsor”) and its affiliates (collectively, the “Promotion Parties”) harmless from, any claim, liability, loss, damage (including punitive, incidental, and consequential damages), or expense (including attorneys' fees) arising out of or in connection with participation in this Campaign or the acceptance, use, or misuse of any RedCoins, coupon or prize. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU. Promotion Parties will not be responsible for: late contributions; technical, hardware, or software malfunctions, lost or unavailable network connections, or failed, incorrect, inaccurate, incomplete, garbled, or delayed electronic communications whether caused by the sender or by any of the equipment or programming associated with or used in this Campaign; by any human error which may occur in the processing of the contributions to this Campaign; or any typographical, technological, or other error in the publishing of the offer, administration of the Campaign. If in the Promotion Parties’ opinion, there is such an error, or there is any suspected evidence of tampering with any portion of the Campaign, or if technical difficulties (including viruses and bugs) compromise the integrity of the Campaign, Promotion Parties reserve the right to cancel or modify this Campaign. In the event of termination, participants will be refunded their contributions in full.
7.Choice of Law and Forum. You agree that all matters arising out of or relating to this Campaign and these Terms and Conditions are governed by, and construed in accordance with, the laws of Texas, without giving effect to any of its conflict of laws provisions thereof. Entrant further agrees that any legal suit, action, or proceeding arising out of or relating to this Campaign and these Terms and Conditions shall be brought exclusively in the applicable federal or state courts located in Dallas, Texas.
8.Privacy. Information submitted with a contribution is subject to the Privacy Policy stated at https://www.oneplus.com/legal/privacy-policy?from=foot. To read the Privacy Policy, click here.
9.General. By participating in this Campaign, you accept and agree to be bound by these Terms and Conditions and the decisions of Promotion Parties on all matters relating to the Campaign, which are final and binding.
10.Grant of Publicity. By contributing to the Campaign and receiving triple RedCoins in return, each participant agrees to, where legal, Promotion Parties’ use of his/her name, city, and state of residence and/or likeness for advertising and publicity purposes in any and all media now or hereafter known throughout the world in perpetuity without further compensation, permission or notification and, upon request, will provide consent to such use in writing.
