The photo contest and long-term collaboration and how to participate

As part of the Power of Community program, OnePlus is hosting different co-creation contests and Long-term Collaboration ("the Contest and Collaboration" or “Contest”).

To participate in the Contest and Collaboration, follow the instructions on this website and accept the following terms and conditions which will form a binding agreement between you and ONEPLUS USA CORP. (“ONEPLUS”).

Rules of Participation for Ideas Submission

1.1. By participating in the Contest, you hereby accept these participation rules (referred to hereafter as "the Rules"). If you do not wish to accept these Rules, please do not enter.
1.2. The Participant must join the Contest by submitting at least one photo or one video ("Submissions") related to the contest theme at XX. All Submissions won't be shared in public. The opening date for submission is XX, and will be an everlasting activity.
1.3. By entering, you warrant and represent the following:(a) you are the sole and exclusive owner of the submission; (b) your Submissions will not infringe on any rights of any proprietary rights, intellectual property rights, industrial property rights, personal or moral rights or any other rights, including without limitation, copyright, trademark, trade names, industrial designs, patent, trade secret, privacy, publicity or confidentiality obligations; (c) any third parties appearing in the Submissions have given you appropriate consent to be photographed and used as permitted herein; (d) your Submissions shall not violate any applicable laws.
1.4. Your Submissions must not be derogatory, offensive, threatening, defamatory, disparaging, libelous or contain any content that is inappropriate, sexual, profane, tortuous, slanderous, discriminatory, or promotes hatred or harm against any group or person, contain any illegal information of a political, pornographic, or violent nature or which may be deemed to support terrorism, or include any disparaging remarks relating to the ONEPLUS or a third party, or is disruptive to public social order and morality or otherwise does not comply with the theme and spirit of this Contest, as the ONEPLUS may deem in its sole discretion.
1.5 OnePlus will enrolll to internal evealuate for all the Submissions to check whether it matches the Contest theme and production right for the Contest. Once your Sumbissions/the ideas are seleceted or be used, OnePlus will give an official permission with further contact.
1.6. You agree to indemnify ONEPLUS and its officers, directors, employees, agents, distributors and affiliates from and against any and all third party claims, demands, liabilities, costs or expenses, including reasonable attorneys’ fees, resulting from your breach of article 1.3 and 1.4 of the Rules.
1.7. Providing a Submission constitutes the your consent to give the ONEPLUS a royalty-free, irrevocable, non-exclusive license to use, reproduce, publish and display such Submissions in whole or in part, on a worldwide basis, in any form, media for one year starting from the submitting date for purposes of implementing the Activity.
1.8. Entry to this Contest is free of charge and is open to all countries. You understand and agree that not all the prizes can be delivered successfully due to the requirement of applicable laws or logistics problems in your country or region. In such an event, ONEPLUS shall have the right to suspend such giveaway without any legal liabilities.
1.9. To qualify for participation in the Contest, you must be over 18 years of age. If under 18 years of age, you must first obtain permission from your parents or legal guardian.
1.10. ONEPLUS is not responsible for entries to the Contest that cannot be processed due to any technical or operational reasons. Entries that are lost, late, misdirected, incorrect, incomplete, for any reason whatsoever, will not be eligible.
1.11. The Contest details form part of these terms and conditions.

Changes to the Rules

2.1. ONEPLUS reserves the right to make reasonable adjustments to the above terms and conditions in keeping with standard practices for similar events and transfer of public gallery rights. Please refer to these terms regularly to ensure you are aware of and understand any changes made by ONEPLUS. By continuing to use this site, you accept these terms and conditions as legally binding regardless of any changes occurring herein.

Privacy and Personal Information Policy

3.1. Personal information collected from each winner will be used by the ONEPLUS for the purpose of delivering their prize. And after the delivering is completed, the ONEPLUS will delete all the personal information. The ONEPLUS will not sell, share or otherwise disclose personal information of winners with third parties, other than to third parties engaged by the ONEPLUS to fulfill the above purposes.

Others

4.1. Any false information provided by you concerning identity, email, ownership or right or non-compliance with the Rules may result in the immediate elimination of you from the Competition.
The ONEPLUS reserves the right to disqualify any entrant from the Contest if, in the ONEPLUS’s sole discretion, it reasonably believes that the entrant has attempted to undermine the legitimate operation of the Contest by cheating, deception or other unfair playing practices or annoys, abuses, threatens or harasses any other entrants or the ONEPLUS. The ONEPLUS reserves the right in its sole discretion to revoke any prizes awarded, at any time.
4.2. The ONEPLUS is not responsible for any problems or technical malfunction of any telephone network or lines, computer online systems, servers or providers, computer equipment, software, failure of any email or entry to be received by the ONEPLUS on account of technical problems or traffic congestion on the Internet or at any website, or any combination of them, including any injury or damage to any entrant’s or any other person’s computer related to or resulting from participation or downloading any materials in this Contest. ONEPLUS is not responsible for any typographical or other error in the printing, offering or announcement of any prize or winners in relation to the entry and participation in the Contest.
4.3. ONEPLUS reserves the right in its sole discretion to cancel, terminate, modify or suspend the Contest (including without limitation the Prizes offered) without any liability whatsoever.
