TERMS AND CONDITIONS

1. NO PURCHASE NECESSARY TO ENTER. VOID WHERE PROHIBITED OR RESTRICTED BY LAW.

2. HOW TO ENTER: Beginning on June 17, 2023 at 5:00 AM EDT through July 20, 2023 at 5:00 AM EDT, log on to www.oneplus.com, go the “OnePlus X Genshin Campaign Page,” click the “Go now” button on the landing page, and follow the on-screen entry instructions. Fill in all required information. You may enter only once. Use of any robotic, automatic, programmed, or similar entry method or entering more than the number of times permitted will void all entries and result in disqualification. You may not enter more times than indicated by using multiple email addresses, identities, or devices in an attempt to circumvent the rules.

3. ELIGIBILITY: Open to residents of U.S. and Canada who are eighteen (18) years of age and older as of June 17, 2023. Void where prohibited.

4. PRELIMINARY TASKS/REWARDS: Participants, by completing any one of the tasks provided, will receive corresponding rewards for each completed task, as follows:

5. DRAWING: Each participant who completes all six (6) tasks will be eligible to participate in a lucky draw and will receive one chance to win a prize (collectively, the “Giveaway”). A random drawing will be conducted to select the winners from among all eligible participants. Odds of winning depend on the number of eligible entries received. A participant will only be confirmed a winner and become eligible to receive a prize after OnePlus USA Corp. (the “Sponsor”) has completed verification of the participant’s eligibility and confirmed the participant’s compliance with these Terms and Conditions. In addition to all of the other requirements stated in these Terms and Conditions, if a participant is a Canadian resident, such participant must correctly answer a mathematical skill-testing question to be confirmed a winner. Potential winners must sign and timely return Sponsor’s Affidavit of Eligibility and any other documentation that is (i) necessary to confirm and verify a participant’s eligibility, as determined by Sponsor, in its sole discretion, and/or (ii) otherwise reasonably required by Sponsor (where permitted by law) (collectively, the “Winner Documentation”). Failure to accurately complete the Winner Documentation and timely return such documentation by the date specified by Sponsor will result in the participant’s disqualification and forfeiture of any prize.  All federal and state laws apply.

6. LIMITATION OF LIABILITY: By entering this Giveaway, entrants waive all right to, and hold the Sponsor and its affiliates (collectively, the “Promotion Parties”), and their respective employees, agents, and assigns, harmless from, any claim, liability, loss, damage (including punitive, incidental, and consequential damages), or expense (including attorneys' fees) arising out of or in connection with participation in this Giveaway or the acceptance, use, or misuse of any coupon, redemption code, or prize. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU. Promotion Parties will not be responsible for: late, incomplete, or incorrect entries; an entrant's failure to receive prize notices due to entrant's spam, junk e-mail, or other security settings or for entrants' provision of incorrect or otherwise non-functioning contact information; technical, hardware, or software malfunctions, lost or unavailable network connections, or failed, incorrect, inaccurate, incomplete, garbled, or delayed electronic communications whether caused by the sender or by any of the equipment or programming associated with or used in this Giveaway; by any human error which may occur in the processing of the entries in this Giveaway; or any typographical, technological, or other error in the publishing of the offer, administration of the Giveaway, or announcement of the prizes. If, in the Promotion Parties' opinion, there is such an error, or there is any suspected evidence of tampering with any portion of the Giveaway, or if technical difficulties (including viruses and bugs) compromise the integrity of the Giveaway, Promotion Parties reserve the right to, in their sole discretion, cancel or modify this Giveaway in a manner deemed appropriate by the Promotion Parties. In the event of termination, winners will be selected from among all eligible entries received as of the date of termination. In the event a dispute arises as to the identity of a potentially winning entrant, entries will be declared made by the name on the online entry form.

Promotion Parties are not responsible for any typographical or other error in the printing of this offer, administration of this Giveaway, or in the announcement of winners and prizes. In the event Promotion Parties are prevented from continuing with this promotion, or the integrity and/or feasibility of the promotion as planned is undermined by any event beyond the Promotion Parties reasonable control, including but not limited to fire, flood, epidemic, pandemic, earthquake, explosion, labor dispute or strike, act of God or public enemy, satellite or equipment failure, riot or civil disturbance, war (declared or undeclared), terrorist threat or activity, or any federal, state, or local government law, order or regulation, or order of any court or jurisdiction (each a "Force Majeure" event or occurrence), Promotion Parties shall have the right, in their sole discretion, to abbreviate, modify, suspend, cancel or terminate the Giveaway and award the prizes from among all eligible entries received up to that date.

7. PRIZES: As noted in Section 4 above, participants, by completing the tasks set forth below, will receive corresponding rewards (with no retail value) for each completed task, as follows:

After completing all six (6) tasks, participants will have the chance to win the following prizes:

- 550 winners will receive 500 Primogems (with an ARV of $6.50) with a redemption code (odds of winning depend on the number of eligible entries received).

-1,650 winners will receive 30 Primogems (with an ARV of $0.40) with a redemption code (odds of winning depend on the number of eligible entries received).

- 2,200 winners will receive 3 Hero's Wit, 5 Mystic Enhancement Ore, and 5 Sweet Madame (with an ARV of $1.00) (odds of winning depend on the number of eligible entries received).

- 9,999 winners will receive a coupon for 5% off all OnePlus phones (ARV varies depending on the phone coupon is applied, odds of winning depend on the number of eligible entries received).

8. GENERAL PRIZE TERMS: The Approximate Retail Value (“ARV”) of the prize(s) is based on information available to Sponsor. None of the Promotion Parties are responsible for, and a winner will not receive the difference (if any) between, the actual value of a prize at the time of the award and the stated ARV in these Terms and Conditions. Prizes are subject to availability and Sponsor reserves the right to substitute a prize of equal or greater value in its sole discretion (which prize shall be subject to these Terms and Conditions). Prize details not specified herein will be determined by Sponsor in its discretion. Prizes are nonrefundable, not redeemable for cash, and nontransferable, and no substitute or alternative (cash or otherwise) is available. The prizes are limited to those specified in Section 7 above, and all other expenses not specifically mentioned herein are not included in the prizes and are solely the winner’s responsibility. Gift cards, gift certificates and tickets, including but not limited to any that may be awarded by Sponsor in the event of a substitute prize, are subject to the terms and conditions specified thereon or otherwise specified by the issuer thereof. If the winner is unable to, or elects not to, use any part of a prize, the winner will forfeit that part of the prize. Any and all taxes (including income tax) or other charges resulting from acceptance of a prize are the sole responsibility of the winner of such prize. The value of any prize awarded to a winner must be reported for tax purposes if required by law, and such winner must provide any additional information requested by Sponsor for purposes of complying with applicable tax reporting obligations. By participating in the Giveaway, participants waive the right to assert any and all claims arising from or related to (i) costs of verification of eligibility or of redemption of, or travel to claim, a prize, and (ii) any liability or publicity that might arise from claiming or seeking to claim a prize. The prize is valid for one (1) year from the date stated in the winner notification. Additional restrictions may apply.

9. CHOICE OF LAW AND FORUM: Entrant agrees that all matters arising out of or relating to this Giveaway and these Terms and Conditions are governed by, and construed in accordance with, the laws of the State of Texas, without giving effect to any of its conflict of laws provisions. Entrant further agrees that any legal suit, action, or proceeding arising out of or relating to this Giveaway and these Terms and Conditions shall be brought exclusively in the applicable federal or state courts located in Dallas County, Texas.

11. GENERAL: By entering this Giveaway, entrants accept and agree to be bound by these Terms and Conditions and the decisions of Promotion Parties on all matters relating to the Giveaway, which are final and binding.

12. GRANT OF PUBLICITY: Acceptance of a prize constitutes, unless prohibited by law, permission to the Promotion Parties to use the winner’s name, city and state of residence, and/or likeness for advertising and publicity purposes in any and all media now or hereafter known throughout the world in perpetuity without further compensation, permission, or notification and, upon request, the winner will provide consent to such use in writing.
