The sponsor of the Lotto is OnePlus Technology (Shenzhen) Co., Ltd. (along with its affiliates, agents, and licensed assigns, the “Company”).
Terms and Conditions
Entrants into the OnePlus 8th Year Anniversary Bold and Boundless Lotto (the “Lotto”) shall be deemed to have accepted these Terms and Conditions. Please do not enter the Lotto if you do not agree to these terms and conditions. Please read them carefully before you participate in the Lotto and keep a copy for your records.
The Lotto is live from December 1, 10:00 AM GMT to December 18, 10:00 AM GMT.
1. ELIGIBILITY:
(a)A participant (“Participant(s)” or “you”) must be at least eighteen (18) years of age at the time of participation. As a Participant, you represent and warrant that you are individuals over the age of eighteen (18) residing in eligible regions in Europe (“Territory”).
(b)To be eligible to win, Participants must subscribe the marketing events to receive an exclusive lotto through the prescribed process before the close of the Lotto.
(c)This Lotto is void where prohibited. Due to legal restrictions, the Company is unable to accept Submissions from Sudan, North Korea, Syria, Iran, Cuba, the Crimea region, or any other countries/regions which may be subject to export controls or sanctions at the time of the Lotto.
2. DETAILS OF THE LOTTO
(a) Participants can participate in the OnePlus 8th Year Anniversary Bold and Boundless Lotto by successfully subscribing the marketing events on OnePlus.in or OnePlus.com
(b) Participants shall begin the process by entering required information of a Name and an Email.
A. Start at the “Share your exclusive birthday card” section on the landing page.
B. Enter the required information of a Name and an Email address and click “Send the invitation card” to subscribe a customized card.
C. A triggered email will be sent to the email address entered. Each email address will receive the automated subscribed email at the first time only.
D. Once clicking the “Send the invitation card”, the discount code will be shown and can be used as described.
(c) Please be aware of the following.
A. Please be aware that each email address can only be verified once within one validity period.Therefore, if Participant enters a repeated email address, Participants won’t receive the email again.
B. Participants can enter any email address you want to share this customized OnePlus 8th Year Anniversary Card, even though the email address entered owner does not subscribe the Campaign.
3. ADDITIONAL TERMS:
(a)Every discount code will be awarded \"AS IS\" and WITHOUT WARRANTY OF ANY KIND, express or implied (including, without limitation, any implied warranty of merchantability or fitness for a particular purpose). There are no cash or other prize alternatives available in whole or in part. However, in circumstances beyond our control, we may substitute a similar alternative prize of equal or greater value in our sole discretion.
(b) We may, to the maximum extent permitted by applicable law and in our sole discretion, change the T&Cs or cancel the Lotto at any time; or modify, terminate, or suspend the Lotto should viruses, worms, bugs, unauthorized human intervention or other causes beyond our control corrupt or impair the administration, security, fairness or proper play of the Lotto or submission of entries. We are not responsible for: (i) lost, misdirected, late, incomplete, or unintelligible entries or for inaccurate entry information, whether caused by you or by any of the equipment or programming associated with or utilized in the Lotto, or by any technical or human error that may occur in the processing of entries; (ii) any printing or typographical errors in any materials associated with the Lotto; (iii) any error in the operation or transmission, theft, destruction, unauthorized access to, or alteration of, entries, or for technical, network, telephone, computer, hardware or software, malfunctions of any kind, or inaccurate transmission of, or failure to receive any entry information on account of technical problems or traffic congestion on the Internet or at any website; or (iv) injury or damage to your or any other computer or mobile resulting from downloading any materials in connection with the Lotto.
We may, in our sole discretion, disqualify any individual found to be: (i) tampering with the entry process or the operation of the Lotto or website or mobile application; (iiv) acting in violation of these T&Cs; or (iii) acting in an unsportsmanlike or disruptive manner or with intent to annoy, abuse, threaten or harass any other person. If your entry is incomplete or if you use robotic, automatic, programmed or similar entry methods, your entry will be void. No benefits greater than those described these T&Cs will be awarded.
4. MISCELLANEOUS :
No requests for transfer or assignment or redemption of the benefits shall be entertained. You agree that all our decisions related to the Lotto are final and binding on you. Failure by OnePlus to enforce any of these T&Cs in any instance shall not be deemed to be a waiver of the T&Cs and shall not give rise to any claim by any person. The decision of OnePlus shall at all times be binding and final.
5. FORCE MAJEURE:
This Lotto is subject to force majeure circumstances including without limitation, floods, natural disasters, war, act of terror, political unrests, technical snags, act of God or any circumstance beyond the reasonable control of OnePlus (\"Force Majeure Event\"). OnePlus shall be not liable for any delay or adverse effect caused to the participants in the Lotto including the winners as a result of a Force Majeure Event.
6. PUBLICITY RELEASE & DATA AND PRIVACY:
(a) By accepting the Lotto, you give OnePlus and/or its affiliates permission to use your name, likeness, image, voice, and/or appearance as such may be embodied in any pictures, photos, video recordings, audiotapes, digital images, and the like, taken or made in relation to the Lotto and any promotions, events, or lucky draws to follow.
(b) OnePlus shall use and take care of any personal information you supply to it as described in its privacy policy, a copy of which can be seen here Privacy Policy - OnePlus that OnePlus and/or its affiliates have the right to publish your saved item details for any communication, promotions, events, or lucky draws that follow. You agree that OnePlus and/or its affiliates have complete ownership of such pictures, etc., including the entire copyright, and may use them for any purpose. These uses include, but are not limited to illustrations, bulletins, exhibitions, videotapes, reprints, reproductions, publications, advertisements, and any promotional or educational materials in any medium now known or later developed, including the internet. You acknowledge that you will not receive any compensation, etc. for the use of such pictures, etc., and hereby release OnePlus and/or its affiliates and its agents and assigns from any and all claims which arise out of or are in any way connected with such use. You give your consent to OnePlus and/or its affiliates, agents and assigns to use your name and likeness to promote the Lotto and any promotions, events, or Lottos to follow.
7. LIABILITY RELEASE:
OnePlus accepts no responsibility for any damage, loss, liabilities, injury or disappointment incurred or suffered by you as a result of entering the Lotto or accepting the prize. Nothing in these Terms and Conditions shall exclude the liability of OnePlus for death, personal injury, fraud or fraudulent misrepresentation as a result of its negligence. Please read the Terms and Conditions mentioned carefully. Non-reading or not knowing any of the clauses will not absolve participants of any liability incurred. In no event shall OnePlus, including its officers, directors, and employees, be liable to you, or any third party, for any special, indirect, consequential losses, including but not limited to, damages for loss of use, loss of time, inconvenience, commercial loss, lost profits, lost business opportunities.
